The proposed theoretical motivation for legal fictionalism begins by focusing upon the seemingly supernatural powers of creation and control that mere mortals exercise over legal things, as a subclass of socially constructed things. This focus brings to the fore a dilemma of uncharitableness concerning the ontological commitments expressed in the discourse of whole societies about such things. Either, there is widespread equivocation as to the fundamental concept expressed by terms such as ‘existence’ or our claims about legal and other institutional (...) things are never really true. When stated as a dilemma, rather than assuming either horn from the outset, our broader social practice of fiction-telling yields a reason to prefer the fictionalist horn. -/- I differentiate three grades of legal fictionalism and contrast strong legal fictionalism with Horacio Spector’s weak form. Only the stronger form has it that engagement in a fictional discourse of law can provide reasons for legal decision-making independent of moral opinions or policy considerations. This stance relies on the claim that maintaining a fictional discourse with respect for its integrity justifies inferences to conclusions about a fictional domain beyond what is described in existing expressions of the discourse. Focusing on ontology allows an analogy between a fictional discourse of law and literary or popular fiction, in which context such inferences are more obviously persuasive. I argue that this notion of respect for the integrity of such a discourse saves legal formalist jurisprudence from the indeterminacy objections of legal realists. (shrink)

That would enable us to then look at live-actor pornography as a form of prostitution that raises additional questions about third party consumption — and analysis both more theoretically coherent and practically useful.

Dewey's pragmatist aesthetics attempts to reconcile the tension between public and private demands on the work of art that has troubled contemporary architecture since the passing of modernism. As a public philosophy of art it holds tremendous promise; but architects will likely find Dewey's characterization of the individual encounter with the work of art less satisfactory. This suggests that Dewey's pragmatism may have over-committed to a singular aesthetic interpretation of the world, lacking the philosophical distance sought by architects. However, pragmatism (...) might inform the reconciliation project as a helpful aesthetic outlook. (shrink)

Dewey's pragmatist regard for the place of rules in moral deliberation occupies a middle ground between the rejection of rules found in Jonathan Dancy's moral particularism and full scale subsumptivism of actions to rules. Concerning the authority rules should play in one's moral thinking, however, Dewey is closely aligned with the particularists: he rejects their authority over individual cases. This essay takes Dewey's naturalistic approach to the derivation of rules to argue that in some cases it is ultimately beneficial to (...) allow rules to occupy a place of authority in moral thinking. The sustainability movement, currently gathering considerable attention from architects, derives much of its moral foundation from the theoretical initiatives of environmental ethics. How is the value of sustainability to mesh with architecture’s time-tested values? The idea that an ethic of sustainability might serve architects’ efforts to reground their practices in something that opposes consumer values of the marketplace has intuitive appeal and makes a certain amount of sense. However, it is far from obvious that the sustainability movement provides a strong (...) enough conceptual framework for an entire designphilosophy. This issue is complicated by two different sustainable design outlooks which parallel two conceptions of environmental ethics: the practical and the radical. Neverthleless, sustainability need not resort to the philosophical excess of its radical branch to help foster a new public-spiritedness. (shrink)

Background: Earlier study without actual trial indicated that caregivers needed delivery of information about outbreak situations independently of their job status. This report describes, for about two months in winter, actual delivery outbreak information to families with preschool children. The study objective was to confirm the usefulness of this information delivery. Method: Participants receiving outbreak information were recruited from the Child Care Support Service in a ward in Tokyo, Japan. Outbreak information was obtained from the Nursery School Absenteeism Surveillance System (...) (NSASSy) covering approximately 40% of all nursery schools in Japan, prescription surveillance and other resources. Delivery of outbreak information started in December 2017 and ceased at the end of February in 2018. After the delivery period, a questionnaire survey was administered to participants. Results: For this area, NSASSy showed the most dominant disease was influenza, with 707 patients, followed by group A streptococcal pharyngitis with 98 patients. The outbreak peak was inferred to be as Monday, 22 January, and it was announced by e-mail on 23 January. Of the 202 persons joined this trial, 60 participants responded to the questionnaire survey after the delivery period. Of those respondents, 98% wanted delivery of that information to continue. Conclusion: We found that almost all respondents confirmed usefulness of the information about infectious diseases which was delivered. (shrink)

The Swiss psychologist Jean Piaget contends that children below the age of 12 see no necessity for the logical law of non-contradiction. I argue this view is problematic. First of all, Piaget's dialogues with children which are considered supportive of this position are not clearly so. Secondly, Piaget underestimates the necessary nature of following the logical law of non-contradiction in everyday discourse. The mere possibility of saying something significant and informative at all presupposes that the law of non-contradiction is enforced.

The aim of this essay is to elucidate the emergence of the concept of Spirit, which constitutes the concrete unity of the oppositions encountered by consciousness, through the lens of Hegel’s theory of action. The key section of Phenomenology of Spirit that serves as the focal point of this inquiry is the moment of Reason titled "The Spiritual Animal Kingdom and Deceit, or the Matter in Hand Itself." In its pursuit of self-realization, Reason presents various forms of the relationship between (...) individuality and its opposite, universality. Initially, rational consciousness seeks to discover itself in the external world through a theoretical and passive approach. However, the inability to reconcile this opposition compels Reason to transition into practical reason, attempting to actualize itself through its own activity. At this juncture, Hegel’s concept of action becomes crucial for resolving the tension between individuality and universality in the transition from Practical Reason to Spirit. Through this concept of action, Hegel reveals a fundamental truth: individuality and universality are not mutually exclusive but rather interdependent for their very existence. In this study, the dialectic between the individual and the universal will first be examined in the context of the relationship between action and work, and subsequently through the notion of "the matter in hand itself" as action. Finally, the conclusion will offer an assessment of the role of action in facilitating the transition from Practical Reason to Spirit. (shrink)

Subscribing to the Platonic concept of the immaterial soul, both Ibn Sina (Avicenna) and Sadraddin Shirazi (Mulla Sadra) accept the idea that human beings possess something beyond the material bodies that represent them in the physical world. However, there are significant differences between their concepts of the soul. One of these differences relates to the origination of the human soul. This paper examines these Muslim philosophers’ approaches to the issue of the soul’s origination. They both consider human souls to be (...) originated, but they differ significantly in terms of the nature of the soul at its origination. Ibn Sina, in line with other Muslim thinkers and defenders of the Platonic soul concept, views it as an immaterial entity upon its coming into existence. However, Mulla Sadra believes that the soul is corporeal at the beginning of its earthly existence. Beyond the issue of the soul’s nature, they also hold different views on how the soul comes into being or is created. Avicenna, as an absolute dualist, believes that the soul is created externally to the body and then added to it, whereas Mulla Sadra holds that it emerges within the body through the evolutionary substantial movement of the latter. Given the variations in these philosophers’ theories on the matter, the paper concludes with the claim that, despite their agreement on the denial of the soul’s pre-existence, there are essential differences between their theories of origination. Ibn Sina appears to be a dualist, while Mulla Sadra leans toward monism. (shrink)

The purpose of the article is to reveal the scientific approach that substantiates the impact of the creation of strategic alliances (SA) on the digital transformation of business and the development of their innovative power based on identified success factors. The aim was achieved using the following methods: abstract logic and typification (for classification of SA's success factors), generalization (to determine the peculiarities of SA's influence on their innovation development), analytical and ranking method (to determine the relationship between the dynamics (...) creating of SA and the degree of acceleration of digital transformation), expert evaluation (to determine the degree of influence of SA success factors by business areas). Implementing a business-integrated approach to understanding digital transformation will accelerate implementation of innovation and organizational change, identifies future prospects for market, customer and business relationships, highlighting the importance of researching the factors that ensure their success. An alternative vision of SA’s success factors is suggested, which are determined by the possibilities the organization of partnerships and organizational culture, integration of business sectors, compatibility of management goals, external relevance, obtaining synergies. Innovation is considered by the authors as an integration factor that reconciles all groups of SA success factors, giving them the necessary focus to solve business problems. The results of the study show that the creation of SA has a significant impact on accelerating and changes priority of digital transformation of business areas involved in strategic partnerships, and the impact of SA on the development of their innovation power is crucial. This paper seeks to bring cosmopsychism, a contemporary metaphysical position on the nature of mind and consciousness, into contact with the philosophical tradition of Hinduism. Behind this exercise lies the motivation to examine how ideas developed within this rich tradition could aid in the effort to think constructively and creatively about issues which occupy the contemporary literature on panpsychism, and in particular cosmopsychism. I argue that, within the Hindu philosophical corpus, contemporary cosmopsychism finds its most natural allies in two world-affirming (...) views: Kashmir Śaivism, and the integral Advaita of Sri Aurobindo. After discussing these views, and their affinities to cosmopsychism, I argue that one important potential contributions of such perspectives lies in the fact that they present us with a form of priority monism little developed within contemporary philosophy. I call this neglected perspective generative monism, and I offer a preliminary exposition of the view and of its explanatory potential. (shrink)

This paper discusses how Thomas Aquinas and some Neo-Thomists scholars (Juan José Urráburu, Joseph Hontheim, Édouard Hugon, and Joseph Gredt) analysed the metaphysical possibility of miracles. My main goal is to unpack the metaphysical toolbox that Aquinas uses to solve the basic question about the possibility of miracles and to compare how his late nineteenth- and early twentieth-century followers solved the issue themselves. The key feature to differentiate the two approaches will reside in their use of different notions to account (...) for the possibility of miracles, namely obediential potency for Aquinas and the laws of nature for the Neo-Thomists. To show why neo-Thomist scholars source to this notion, I also briefly discuss how the notion of the laws of nature emerged in the seventeenth century. (shrink)

In this book, Ilhan Inan questions the classical definition of curiosity as _a desire to know._ Working in an area where epistemology and philosophy of language overlap, Inan forges a link between our ability to become aware of our ignorance and our linguistic aptitude to construct terms referring to things unknown. The book introduces the notion of inostensible reference. Ilhan connects this notion to related concepts in philosophy of language: knowledge by acquaintance and knowledge by description; the referential and the (...) attributive uses of definite descriptions; the _de re/de dicto_ distinction; and Kripke’s distinction between rigid and accidental designators. Continuing with a discussion of the conditions for curiosity and its satisfaction, Inan argues that the learning process—starting in curiosity and ending in knowledge—is always an effort to transform our inostensible terms into ostensible ones. A contextual account is adopted for the satisfaction of curiosity. It then discusses the conditions of successful reference to the object of curiosity and its presuppositions. The book concludes with a discussion on the limits of curiosity and its satisfaction. (shrink)

Background: Dengue Disease is a mosquito-borne tropical disease caused by the dengue virus, symptoms typically begin three to fourteen days after infection. This may include a high fever, headache, vomiting, muscle and joint pains, and a characteristic skin rash. Dengue serology is applied in different settings, such as for surveillance, in health care facilities in endemic areas and in travel clinics in non-endemic areas. The applicability and quality of serological tests in dengue endemic regions has to be judged against a (...) background of potential cross reactivity with other flavi-viruses, difficulties in distinguishing primary from secondary infections and technological problems related to the fact that most dengue endemic regions are relatively poor of resources .Objectives: to help doctors and patients in diagnosing Dengue Disease and give them the information of how to prevent Dengue Disease and to be able to understand the signs and symptoms of Dengue Disease. Methods: We collected all relevant material for Dengue Disease. Then we designed and implemented a knowledge based system for diagnosing Dengue Disease using SL5 Object Language. Results: The knowledge based system was evaluated by a group of Patients and specialized doctors and they found it very friendly and easy to use. (shrink)

In this paper, I analyse Agrippa’s trilemma, an old skeptical argument that questions the possibility of justifying any arbitrary belief p and its paradox about jus-tification. Assuming that neither infinitism nor skepticism are satisfactory positions, the main alternatives available to face the problem (foundationism, coherentism and epistemic externalism) are outlined, as well as some central arguments that show the serious difficulties they face. In the case of foundationalism, these problems arise from two dilemmas, which work together with the trilemma to (...) make our philosophical life even more difficult: the so-called Sellar’s dilemma and Bergmann’s dilemma —although the latter is a very general attack on internalism. The former calls into question the inte-lligibility of a key idea of standard foundationalism: the notion of justified basic belief. The second casts doubt on the rational sustainability of epistemic internalism, which is a usual presupposition of the presentation of the trilemma. I explore a Humean way out of the trilemma that also manages to escape such dilemmas. Like any position in this difficult territory the way out has costs. However, they do not seem unaffordable. Here I only intend to tentatively present the idea, as a possible way out of our difficulties, which deserves to be seriously discussed. (shrink)

The paper begins with the assumption that in order to explain the efficacy of harmony as an organizing force in human and natural affairs we must pay attention to the dynamic features characteristic of the growth and maintenance of harmonious forms. Two dynamic features are highlighted for their especial significance: revitalization, and self-surpassing. It is then argued that the two are substantively connected through the agency of creativity which, when given free reign, tends to preserve and fortify harmony by surpassing (...) existing harmonious configurations. It follows that the impetus towards self-transcendence is a vital aspect of the growth, the sustenance, and the flourishing of harmony. I then argue that this urge towards self-transcendence can be broadly identified with Plato's notion of Eros. Nevertheless, I also argue that this affinity does not commit us to a rigid Platonic scheme of the sort criticized by Chenyang Li (2014) as harmony by conformity. (shrink)

I show that the recent account of levels in neuroscience proposed by Craver and Bechtel is unsatisfactory since it fails to provide a plausible criterion for being at the same level and is incompatible with Craver and Bechtel’s account of downward causation. Furthermore, I argue that no distinct notion of levels is needed for analyzing explanations and causal issues in neuroscience: it is better to rely on more well-defined notions such as composition and scale. One outcome of this is that (...) apparent cases of downward causation can be analyzed away. (shrink)

Scientists often diverge widely when choosing between research programs. This can seem to be rooted in disagreements about which of several theories, competing to address shared questions or phenomena, is currently the most epistemically or explanatorily valuable—i.e. most successful. But many such cases are actually more directly rooted in differing judgments of pursuit-worthiness, concerning which theory will be best down the line, or which addresses the most significant data or questions. Using case studies from 16th-century astronomy and 20th-century geology and (...) biology, I argue that divergent theory choice is thus often driven by considerations of scientific process, even where direct epistemic or explanatory evaluation of its final products appears more relevant. Broadly following Kuhn’s analysis of theoretical virtues, I suggest that widely shared criteria for pursuit-worthiness function as imprecise, mutually-conflicting values. However, even Kuhn and others sensitive to pragmatic dimensions of theory ‘acceptance’, including the virtue of fruitfulness, still commonly understate the role of pursuit-worthiness—especially by exaggerating the impact of more present-oriented virtues, or failing to stress how ‘competing’ theories excel at addressing different questions or data. This framework clarifies the nature of the choice and competition involved in theory choice, and the role of alternative theoretical virtues. (shrink)

Can we transmit understanding via testimony in more or less the same way in which we transmit knowledge? The standard view in social epistemology has a straightforward answer: no, we cannot. Three arguments supporting the standard view have been formulated so far. The first appeals to the claim that gaining understanding requires a greater cognitive effort than acquiring testimonial knowledge does. The second appeals to a certain type of epistemic trust that is supposedly characteristic of knowledge transmission (and maybe of (...) the transmission of epistemic goods in general) and that is allegedly incompatible with understanding. The third aims to show that there is a certain aspect of understanding (what epistemologists these days like to call “grasping”) that cannot be passed on to another person via testimony alone. In this article, I show that all of these arguments can be resisted. Thus, there seem to be no compelling reasons to embrace the standard view. (shrink)

In this paper I argue that it is finally time to move beyond the Nagelian framework and to break new ground in thinking about epistemic reduction in biology. I will do so, not by simply repeating all the old objections that have been raised against Ernest Nagel’s classical model of theory reduction. Rather, I grant that a proponent of Nagel’s approach can handle several of these problems but that, nevertheless, Nagel’s general way of thinking about epistemic reduction in terms of (...) theories and their logical relations is entirely inadequate with respect to what is going on in actual biological research practice. The idea of levels of organization plays a central role in the philosophy of the life sciences. In this article, I first examine the explanatory goals that have motivated accounts of levels of organization. I then show that the most state-of-the-art and scientifically plausible account of levels of organization, the account of levels of mechanism proposed by Bechtel and Craver, is fundamentally problematic. Finally, I argue that the explanatory goals can be reached by adopting a deflationary approach, where levels of (...) organization give way to more well-defined and fundamental notions, such as scale and composition. The approach to the study the role of strategic alliances in the conditions of digital business transformations has been further developed in the article. In the course of a critical analysis of the content of scientific publications of modern scientists who studied the behavior, peculiarities of activity and the meaning of strategic alliances, it was established that the role of strategic alliances in the conditions of digital transformations does not disappear, but brings new advantages, requiring the maximization of returns from (...) more dynamic partnership relations, which requires more in-depth study of such benefits. Dynamics analysis of the number of concluded agreements in the field of strategic partnership in the period of 2014-2023 demonstrates their increase starting from 2017, which led to the activation of digital business transformations. In the course of research, it was determined that the role of strategic alliances in the conditions of digital business transformations is to ensure strategic flexibility under the conditions of continuity of digital transformations, improve competitive positions on the market, increase their innovativeness and efficiency, improve organizational stability and the ability of companies to learn, create opportunities for obtaining synergistic effect. It develops the ability of companies to proactively manage changes, contributes to the joint solution of strategic tasks and goals of partner companies, provides significantly greater opportunities for the development of innovative processes through the development and implementation of new methods and forms of work, new solutions in economic sectors, innovations in management, contributes to survival in market competitive environment and is an important competitive imperative to ensure overall long-term digital transformation. Climate change is considered as the global challenge in the 21st century. Anthropogenic activities have directly led to an immense increase in green house gas emissions mainly carbon dioxide that contributes mainly in the warming of atmosphere. The concentration of carbon dioxide is expected to rise twice as high as those existing in pre-industrial period, within the next century. Pesticides are the biological pollutants, which are being used by the man to kill the pests for increasing the yield of many (...) crops and insect vectors to control the spread of disease. The tremendous use of pesticides has caused severe health hazards to organisms including human beings due to climate change. Excessive use of pesticides may lead to the destruction of biodiversity. Many birds, aquatic organisms and animals are under the threat of harmful pesticides for their survival. The pesticides effects are lessen by organizing awareness program among the farmers, gave special training to them regarding consequences of pesticides, their screening and monitoring methods. In this paper, I argue that the conscious awareness one has of oneself as acting, i.e., agentive awareness, is not a type of sensory awareness. After providing some set up in Sect. 1, I move on in Sect. 2 to sketch a profile of sensory agentive experiences as representational states with sensory qualities by which we come to be aware of ourselves as performing actions. In Sect. 3, I critique two leading arguments in favor of positing such sensory experiences: the (...) argument from pathology and the argument from cognitive impenetrability. Since neither of these arguments succeeds, the case for positing SAEs is dealt a significant blow. I proceed in Sect. 4 to advance my positive argument against SAEs. The argument runs as follows: If SAEs exist, then they must exist in some sensory modality or set of sensory modalities. Either the relevant sensory modalities are ones that we already recognize, or they are novel sensory modalities. I will argue that neither of these options is workable, and so we have nowhere to locate SAEs. Agentive awareness is not sensory awareness. (shrink)

Although scientific realism is the default position in the life sciences, philosophical accounts of realism are geared towards physics and run into trouble when applied to fields such as biology or neuroscience. In this paper, I formulate a new robustness-based version of entity realism, and show that it provides a plausible account of realism for the life sciences that is also continuous with scientific practice. It is based on the idea that if there are several independent ways of measuring, detecting (...) or deriving something, then we are justified in believing that it is real. I also consider several possible objections to robustness-based entity realism, discuss its relationship to ontic structural realism, and show how it has the potential to provide a novel response to the pessimistic induction argument. I argue that Nietzsche’s criticism of the Kantian theory of disinterested pleasure in beauty reflects his own commitment to claims that closely resemble certain Kantian aesthetic principles, specifically as reinterpreted by Schiller. I show that Schiller takes the experience of beauty to be disinterested both (1) insofar as it involves impassioned ‘play’ rather than desire-driven ‘work’, and (2) insofar as it involves rational-sensuous (‘aesthetic’) play rather than mere physical play. In figures like Nietzsche, Schiller’s generic notion of play—which is itself (...) influenced by Kant’s claim that aesthetic pleasure is orthogonal to desire-satisfaction—becomes decoupled from his (further) Kantian view that aesthetic play essentially involves a harmony of sensuous receptivity and rational spontaneity. The result, I suggest, is a self-standing opposition between desires and passions. This motivates a recognizably Romantic vision of aesthetic disinterestedness, as freedom from desire realized in a state of creative determination by passion. (shrink)

Digitalization is closely intertwined with strategic flexibility, forming opportunities for the introduction of new technologies and serving as the basis for business development. This ensures faster identification of problems and modification of resource requirements due to timely response to changes in the external business environment and breaks the relevance of further research towards the implementation (...) of the research goal. Analysis of the content of scientific works of scientists revealed insufficient attention to the study of the relationship between digitalization and strategic flexibility as the basis for solving strategic tasks of business development. The feasibility of digital transformations in the field of strategic management is determined in the work. The conceptual relationships of digitalization, strategic flexibility and business development are disclosed. The purpose of Business Model Canvas for business development is summarized. The matrix of choosing innovative strategies for business development has been proposed, taking into account the digitalization trajectory and the level of business flexibility, which will ensure its sustainable development in the future. The paper presents a pioneering approach to assessing the effectiveness of innovation processes in logistics. Indicators and the procedure of evaluating the efficiency of innovation processes in enterprise logistic activity are described. Possibilities of applying this approach are suggested.

The current study is conducted to examine the following research questions: 1) How are information trustworthiness, usefulness, and immersiveness associated with the general intention to try space tourism? 2) Does the uncertainty of information (proxied by information trustworthiness) moderate the associations between information usefulness, immersiveness, and the general intention to try space tourism?

The aim of this article is to show that ontological toleration is an important component of recognition in the realization of ethical life (as “the living good”) and true freedom. To achieve this aim, I will propose a new reading of Hegel’s account of recognition and its union with toleration by appealing to his arguments of the master-slave dialectic in relation to “something and an other” and the One in the Science of Logic. By doing so, I hope to present (...) a Hegelian account of toleration as a precondition for recognition, and thereby, fill a gap in the current literature on recognition and its relation to toleration. Although there are many articles on Hegel’s theory of recognition, there are only a few texts on Hegel’s account of toleration, which shows that it has been a largely neglected topic in the literature. As I will demonstrate in this article, toleration, specifically −what I call− ontological toleration is an important and an indispensable part of Hegel’s theory of recognition, which plays a foundational role for his account of ethical life and true freedom. The current study is conducted to examine the following research questions: 1) How are gender, age, and income associated with trying space tourism? 2) How are gender, age, and income associated with the intention to try space tourism when conditional on the level of immersiveness in information on social media?

We chart how neuroscience and philosophy have together advanced our understanding of moral judgment with implications for when it goes well or poorly. The field initially focused on brain areas associated with reason versus emotion in the moral evaluations of sacrificial dilemmas. But new threads of research have studied a wider range of moral evaluations and how they relate to models of brain development and learning. By weaving these threads together, we are developing a better understanding of the neurobiology of (...) moral judgment in adulthood and to some extent in childhood and adolescence. Combined with rigorous evidence from psychology and careful philosophical analysis, neuroscientific evidence can even help shed light on the extent of moral knowledge and on ways to promote healthy moral development.
